This is what you're going to run into problems with...

that the firearm shall be relinquished to the local law enforcement

that proof of surrender or sale shall be filed within a specified
time of receipt of the order. The order shall state the penalties for
a violation of the prohibition. The order shall also state on its
face the expiration date for relinquishment.
If the pawnshop has sold those firearms instead of storing them as per contract, you may have some cause of action against them for breach of contract, but the law states that you had to either relinquish them to Law Enforcement or sell them to a dealer. I don't know if you'll get anywhere though.

Just thought I'd chime in again here. I am the original author of this thread which I wrote shortly after purchasing a pistol from Pro Defense Firearms...............well, long story short.....I purchased a little .22 pistol for my wife 22 days ago and still don't have possession of the gun due to confusion over the proper waiting period between purchase dates. Basicly Pro Defense Firearms dropped the ball, and I will be presenting my wife with a receipt for her new Walther P22 on her birthday instead of the the actual gun which I could have legally had in my possession like 10 or 11 days ago. BUT, the guy who runs the shop (not sure if it's you Greg) says he will make it up to me by refunding some of his profit plus the $25 dealer fee. I was already getting a good price on the gun so I think this is fair. If they make good on their word, I would not hesitate to become a return customer. I'll keep you all posted.

Picked up the P22 the other day. They refunded me the dealer fee which I used to buy a Glock 26 mag. I'm happy with the way they handled their screw up. I would do business with them again.............

By "buying it for her" I meant that it was purchased specifically as a tool to teach her the fundamentals of shooting. Her actual birthday present was a trip to Vegas last weekend. It will be in my safe and it will be cleaned and maintained by me. She has tried shooting my glock and my .38 special but gets freaked out by the recoil so she asked me if I could purchase a new gun that would be easier "for her" to learn with. So it's just something special I did for her birthday to include her in one of my favorite activities. I would otherwise have no use for a .22. Hopefully she will want me to teach her how to shoot a Kimber Ultra CDP next I told the dealer straight out that I was buying it to teach my wife to shoot. Last time I checked that's not a straw purchase.

Good choice for ladies .. I had one for a few years ago that I used to teach girls I dated. I have since gotten married, but "all" of the past girls are now much more gun-friendly..... just not "nik-friendly" if you know what I mean. I did my service to society by enlightening the ladies with proper handling and expanded their horizon to firearms.

On the BATF&E web site "Don't lie for the other guy" first scenario is yours. Dealer tells the husband to buy a gift certificate to keep it legal.
