The local police dept believes they are stalling and have already sold my firearms.
We're a CCW board and it sounds like you'll need the help of your attorney to straighten things out. You’re not allowed to own, possess, purchase or receive firearms for the duration of your R.O. Good luck.

This is what you're going to run into problems with...

Quote:
(3) The Judicial Council shall provide notice on all protective
orders that the respondent is prohibited from owning, possessing,
purchasing, receiving, or attempting to purchase or receive a firearm
while the protective order is in effect. The order shall also state
that the firearm shall be relinquished to the local law enforcement
agency for that jurisdiction or sold to a licensed gun dealer, and
that proof of surrender or sale shall be filed within a specified
time of receipt of the order. The order shall state the penalties for
a violation of the prohibition. The order shall also state on its
face the expiration date for relinquishment.
If the pawnshop has sold those firearms instead of storing them as per contract, you may have some cause of action against them for breach of contract, but the law states that you had to either relinquish them to Law Enforcement or sell them to a dealer. I don't know if you'll get anywhere though.

Just thought I'd chime in again here. I am the original author of this thread which I wrote shortly after purchasing a pistol from Pro Defense Firearms...............well, long story short.....I purchased a little .22 pistol for my wife 22 days ago and still don't have possession of the gun due to confusion over the proper waiting period between purchase dates. Basicly Pro Defense Firearms dropped the ball, and I will be presenting my wife with a receipt for her new Walther P22 on her birthday instead of the the actual gun which I could have legally had in my possession like 10 or 11 days ago. BUT, the guy who runs the shop (not sure if it's you Greg) says he will make it up to me by refunding some of his profit plus the $25 dealer fee. I was already getting a good price on the gun so I think this is fair. If they make good on their word, I would not hesitate to become a return customer. I'll keep you all posted.

Picked up the P22 the other day. They refunded me the dealer fee which I used to buy a Glock 26 mag. I'm happy with the way they handled their screw up. I would do business with them again.............

Would this be considered an illegal straw purchase?

By "buying it for her" I meant that it was purchased specifically as a tool to teach her the fundamentals of shooting. Her actual birthday present was a trip to Vegas last weekend. It will be in my safe and it will be cleaned and maintained by me. She has tried shooting my glock and my .38 special but gets freaked out by the recoil so she asked me if I could purchase a new gun that would be easier "for her" to learn with. So it's just something special I did for her birthday to include her in one of my favorite activities. I would otherwise have no use for a .22. Hopefully she will want me to teach her how to shoot a Kimber Ultra CDP next I told the dealer straight out that I was buying it to teach my wife to shoot. Last time I checked that's not a straw purchase.

Good choice for ladies .. I had one for a few years ago that I used to teach girls I dated. I have since gotten married, but "all" of the past girls are now much more gun-friendly..... just not "nik-friendly" if you know what I mean. I did my service to society by enlightening the ladies with proper handling and expanded their horizon to firearms.

Sounds like the good old days at Wilson's with his German Short-hairs running around the shop area.

My husband bought me a .38 Special for a birthday gift a few years and the I bought him a Glock 9mm for Easter the following year. The dealer knew they were gifts at the time of purchase.
Both of which are listed on MY CCW.

And both of those were illegal straw purchases.

On the BATF&E web site "Don't lie for the other guy" first scenario is yours. Dealer tells the husband to buy a gift certificate to keep it legal.

Unhappy BEWARE: Bad Business Practices

Pro Defensive in Redlands has gone sour...

My boss paid him over a $1000 and never got his, has been back so many times to only find the door locked with nobody there (or answering because they have a camera and can choose who to let in) and now they're being evicted in a day or two. The owner, Steve, doesn't return phone calls or emails either. He's pretty slimy.

Plus, I know of another raw deal in which he owes another guy 10x that amount. Apparently, Steve made deals that he never delivered on and probably never had any intention of doing. He seems like such a nice guy but that's all an act.

BEWARE. If you have any business left to transact with this loser, good luck. If you know how to find him, please post or let me know.

Holy necropost Batman! .......always wanted to say that.

BTW a
Quote:
A straw purchase is an illegal firearm purchase where the actual buyer of the gun, being unable to pass the required federal background check or desiring to not have his or her name associated with the transaction, uses a proxy buyer who can pass the required background check to purchase the firearm for him/her. It is highly illegal and punishable by a $250,000 fine and 10 years in prison.
So, buying a gun as a gift for someone to whom it will eventually be transferred (or perhaps loaned for the statutory time period) who the original buyer fully expects to be qualified, is not a straw purchase. Long guns can be literally handed to the recipient, handguns should be registered using http://ag.ca.gov/firearms/forms/pdf/oplaw.pdf ..........which can be used for vertical transferring, (son to dad, granddad, etc, spouses, and EVEN registered domestic partners.)

Default Pro Defensive Firearms in Redlands

I hate to make a post such as this but I do not recommend this place. I bought an AR15 lower from them and it's been 90 days since I made my purchase and 45 days of it the business has been closed at one point sighting family emergency. Should this place reopen I would not recommend you do business with them. I can not get a phone call, email, or any other communication attempt returned.

If you know the owners or if the owner is still on the sight please feel free to PM me.
