Default Hello

I'm from South Carolina, have a CWP here and am planning on another visit to California; thought I would check out the firearm laws in your state. Wow. First impression, what a mess. We have the worst high school drop-out rate and SAT scores in the country here in SC but (small compensation, but it's something) the Castle Doctrine is alive and well in the birthplace of the civil war and a man can defend himself in his home, car, hotel room or place of business.

I love California. I hope you guys can get some relief.

Anyway, I have enjoyed the forum thus far and appreciate your efforts toward common sense.

Welcome, cliff. Thanks for the kind words about our forum. Yes, there are a lot of restrictions here. It's a constant struggle to keep what we've got, let alone change things for the better, but that's what we hope to do. What part of CA are you coming to visit? Obviously your state permit isn't honored here (sorry about that). If you transport a handgun in a vehicle, it has to be unloaded and in a locked container, ammunition kept separate (ammo doesn't have to be locked. No high cap (over 10 round) mags allowed.

California was the first state to have this law. 1996 See P.C. 198.5

I'm learning. Just curious, in SC, without a permit, it is lawful to:
carry a handgun from a car to a motel room and, in effect, the motel room becomes "home" for purposes of self defense
defend oneself at home with deadly force without requiring that the intruder(s) actually enter a residence; that is, anywhere within the limits of one's property may be protected by force lawfully
same applies to a business. as I understand it, in his own home or business, a man may openly carry and use a handgun
.

Are these also elements of the California law?
Could a non-resident (or resident, for that matter) legally arm him/herself in his hotel room?
Disclaimer: I'm no expert--just took and passed the CWP certification course in South Carolina and read the laws as best I could once or twice--so I will not be offended if corrected.

So, for example, a Glock 17 semiautomatic (with 17 rounds in the mag) is an unlawful weapon in California, period? Does that include law inforcement?

Thanks.

In the privacy of your motel or hotel room, you may open carry or conceal carry as you wish. But you will not want to advertise to the general public passing by and seeing you attired as such through a wide open door or window.

Those who had the magazines prior to the ban were grandfathered in. The pistol in okay the magazine isn't. LEOs are excempt from the magazine ban.

Thanks for the info. I assume the mag is illigal even if it only is loaded to the legal limit.

I have attached a link where another member was asking the same questions. Hope that this helps. Have an enjoyable visit. Remember California does not recognize out of state permits.

That is correct. It is capacity of the magazine that renders it illegal, whether or not it is fully loaded.
