Default Protected Person

Greetings,

I am a protected person on a non-expiring criminal protective order. The white-supremacist gang-member that killed my two children four years ago (gross vehicular manslaughter) will be paroled this month from Pelican Bay.

How would I go about obtaining a CCW. I have received defensive handgun training. However, I am a LA County resident.

I understand there may be exceptions to the issue rules because of the protective order.

Out of the 377 permits issue by Los Angeles Sheriff Department, only one person was not a who's who of L.A.

We think that one person who nobody can find anything about, just might have a good reason.

That said, you mght give it a try, you have a better chance than most.

Would you consider moving to Orange or San Bernardino Counties? You would have a much better chance getting approved for a CCW.

Regarding the Penal Code exception for persons who are under protective order, you need to speak to an experienced firearms attorney before you make that choice. My understanding is you may use that as a defense AFTER your are arrested and charges are filed.

I agree, you should proceed with the CCW application process.

i could only suggest moving to a county where the Sheriff believes in law abiding citizens.

I re-read the original post and my post. I think I should clarify a couple things.

1) There is no automatic Good Cause even for cases like yours. The GC of having a protective order should be valid in any jurisdiction but it's really up to the discretion of that jurisdiction's Chief Law Enforcement Officer. That can be a very big hurdle in LA County.

2) When I mentioned exceptions in the PC regarding persons who are under protective order, I was referring to the legal defense one might use to avoid being convicted of carrying a concealed or loaded weapon without a CCW license. The point I am trying to make is this: I STRONGLY ADVISE AGAINST CCW WITHOUT A LICENSE.

You sound like a reasonable candidate for a rare LA County permit. Make sure you completely document any threats received and documentation relating to the case, and in particular what circumstances led to the order.

Your city is served by LASO, so you would need to apply there.
