Default Carrying w/o ccw

Can someone explain the law and ramifications if you get caught CCWing w/out a CCW license?

Misdemeanor if caught, unloaded, felony if loaded, I believe. Please read 12025. And this site specfically does not endorse anyone, anytime, CCWing without a proper permit.

"12025. (a) A person is guilty of carrying a concealed firearm when
he or she does any of the following: ..."

Except where legal, such as your home.

Edited to add: And I think the first time is a misdameanor and the second time is a felony.

Don't do it.

Usually people are charged with both 12025 (Concealed) and 12031 (Loaded). Either can be a felony or misdemeanor depending on the circumstances.
If you're in a school zone they will add another charge. It gets real complicated and expensive if the arresting officers can make a case for felony filings and/or enhancements. Your lawyer will charge you a lot of money to get your charges reduced to misdemeanors.

You ask about ramifications? If unsuccessful at getting your charges reduced and you get convicted of a felony, kiss your gun rights goodbye forever.

Thanks, I'm going to go read 12025 right now. What is considered loaded, round in chamber, or just clip in gun?

Clips go in hair, magazines go in guns.

One round in a magazine in your handgun and it is loaded, whether the round is in the chamber or not. One round in the magazine with the mag outside the gun sitting next to it will get you in trouble too, unless the gun is in a separate, locked container.

Thats a weird one huh???

Keep in mind, if you have a restraining order on somebody for specific threats of violence, you can legally carry sans permit under 12025.5/ 12031 (j)(2) (keep in mind however, its an affirmative defense, meaning the JURY gets to decide whether you were justified or not).

I would suggest that everybody read 12025.5 (b) as well.... But I wont read that one for you.... You're on your own with that.
