Default DC Denies Richard Heller a handgun license

DC Rejects Handgun Application

WASHINGTON (WUSA) -- District residents can start registering their guns today. But at least one very high profile application was already rejected.

Richard Heller is the man who brought the lawsuit against the District's 32-year-old ban on handguns. He was among the first in line Thursday morning to apply for a handgun permit.

But when he tried to register his semi-automatic weapon, he says he was rejected. He says his gun has seven bullet clip. Heller says the City Council legislation allows weapons with fewer than eleven bullets in the clip. A spokesman for the DC Police says the gun was a bottom-loading weapon, and according to their interpretation, all bottom-loading guns are outlawed because they are grouped with machine guns.

Besides obtaining paperwork to buy new handguns, residents also can register firearms they've had illegally under a 180-day amnesty period.

Though residents will be allowed to begin applying for handgun permits, city officials have said the entire process could take weeks or months.

Well... That was no coincidence....

Now he can go back to the district Court (who still have jurisdiction over the original case I believe) and ask that the City be compelled to register his gun in accords with Heller. If they dont comply with the order, the Court can start issuing Contempt charges.

If I were a resident of D.C. Id walk into the city treasurers office, slap a big steaming dog turd on the counter, and say "Im here to pay my property taxes."

I heard this argument pop up before - that only revolvers would be allowed to be registered and that any firearm capable of accepting 11 (or 12?) or more rounds of ammo (and whatever else that silly law states) is considered illegal by another statute.

Once again, this is from the DC code. I see no where in these words where the DC police can interpret that a bottom loading pistol is a machine gun!

Rea some of the comments and there is some doubt about the accuracy of the news report. That's surprising. One comment stated that the gun did not get registered because it was capable of exceeding the 12 round limit.

Any magazine loaded gun CAN exceed twelve rounds....

My guess: D.C. is hoping that whatever judge gets Heller's complaint will refuse to issue an injunction. Then the case will go forward, D.C. hoping that it makes it to SCOTUS after a couple years, when there will be at least one new justice, appointed by a Democrat president. And that will be the end of "Heller."

Of course, Heller ought to have a great civil rights case in the making here.
