The center console would be in your immediate control but it would also be in the immediate control of someone in the passenger seat. That's why mine rides in the driver door pocket; definitely under my control only.

Listen guys... It all boils down to common sense.... The "immediate control thing" is to prevent somebody else who isnt authorized to get the gun from getting it (your kid in the back seat, your drunk buddy in the passenger seat... etc). If I'm in the car alone, I dont worry much about where I put the gun... Its a tactical question at that point and not a legal one. But if my kid is in the car, or I have passengers, then I have to make sure I dont put the gun somewhere where they might pick it up. Use common sense and you'll be fine.

From my own personal standpoint, I would say that if you, a CCW holder, are in the car alone or with another adult, then anywhere concealed in the car would be fine.
If you are in the car with a child, I would be concerned about 12035(b)(1) (criminal storage) issues if the gun is anywhere but on your person, or under your elbow in the console. |

I would like to change the scenario a little bit and then ask a question. I have a CCW license. I have been thinking about keeping a fully loaded gun (one that is listed on my CCW license) in the trunk of my car for those occasions when I intentionally leave my home without a gun or when I forget to carry one. (Please no comments about forgetting to carry a gun.) I am the only one with keys to my car. CCWInstructor stated that the gun must be under the CCW licensee's dominion and control. As far as I am concerned, the gun in the trunk of my car (and not being in an additional locked container) remains under my dominion and control since I have the keys to the car. I realize there may be issues if I give a key to a valet but if that is not the case and I always have the keys with me, am I in compliance with the law?
