I would never keep a gun in my glove box.

1 - that's the first place a burglar looks
2 - if you get pulled over and the LEO wants your car's paperwork - BUSTED!!
3 - it's a pain to get to from the driver's seat in most vehicles
4 - I thought CCW meant you have it on your person or in easy reach

Will Rogers said, "There's three kinds of people. There's them that can learn from others, there's them that can learn from books, and there's them that has to whiz on the electric fence for themselves."

I prefer to be one of the first two kind and to learn from others' mistakes.

Please educate me on the following: If I own a center of mass locking gun case, can I keep the pistol locked under the seat, in the case, with a loaded mag, without a CCW?

Remember there's a distinction between "technically legal" and "will keep you from getting arrested."

In this case, if you don't have a CCW or are transporting a firearm not listed on your permit, you generally want the lock between the gun and the ammunition. So you could keep the pistol locked in a C-O-M case under the seat, and have a loaded magazine in the center console, and you're fine.

The center console would be in your immediate control but it would also be in the immediate control of someone in the passenger seat. That's why mine rides in the driver door pocket; definitely under my control only.

Listen guys... It all boils down to common sense.... The "immediate control thing" is to prevent somebody else who isnt authorized to get the gun from getting it (your kid in the back seat, your drunk buddy in the passenger seat... etc). If I'm in the car alone, I dont worry much about where I put the gun... Its a tactical question at that point and not a legal one. But if my kid is in the car, or I have passengers, then I have to make sure I dont put the gun somewhere where they might pick it up. Use common sense and you'll be fine.

From my own personal standpoint, I would say that if you, a CCW holder, are in the car alone or with another adult, then anywhere concealed in the car would be fine.
If you are in the car with a child, I would be concerned about 12035(b)(1) (criminal storage) issues if the gun is anywhere but on your person, or under your elbow in the console.

I know what you mean. I'm no little guy either and I'm pretty cramped in my truck as it is!

Default A Slightly Different Scenario

I would like to change the scenario a little bit and then ask a question. I have a CCW license. I have been thinking about keeping a fully loaded gun (one that is listed on my CCW license) in the trunk of my car for those occasions when I intentionally leave my home without a gun or when I forget to carry one. (Please no comments about forgetting to carry a gun.) I am the only one with keys to my car. CCWInstructor stated that the gun must be under the CCW licensee's dominion and control. As far as I am concerned, the gun in the trunk of my car (and not being in an additional locked container) remains under my dominion and control since I have the keys to the car. I realize there may be issues if I give a key to a valet but if that is not the case and I always have the keys with me, am I in compliance with the law?

NO

within arms reach is the rule of thumb + as soon as you leave the car, the loaded gun is no longer in your immediate control. Once you exit the car, the gun needs to be unloaded and locked in a case OR loaded and on your body (if on your ca ccw permit).
