Default Unfriendly Gun Business - The Irvine Company

Just received this email! Thank goodness I now have a new landlord... Not sure if this would even be legal for them to do...


Dear Tenant:

Pursuant to the terms of your Lease, the landlord reserves the right to adopt rules and regulations for the office project as it deems reasonable and appropriate from time to time. In order to enhance the safety and well-being of tenants and other occupants, it is important that firearms not be brought to the project. Even unloaded weapons may, if observed, create the appearance of a threat and result in police intervention. Accordingly, the following requirement shall henceforth be in effect and is adopted as a new project rule in accordance with your Lease:

Neither Tenant nor its employees, agents, contractors, invitees or licensees shall bring any firearm, whether loaded or unloaded, into the Project at any time.

So they're telling you that you can't own or possess any firearms in your residence?

It sounds like a business rental? But either way I would find new diggs and let them know why. The problem is that the only thing it will do is make them happy that their policy is working I would guess.

Also, I am not sure a residential lease can restrict the lawful use of a residence. I would be very surprised if you as a landlord could refuse someone the ability to keep a firearm at home.

Any landlords or lawyers out there have an opinion on this?

To be clear, i believe local statute could overrule what I'm about to say (though i think it would be overturned in court)...

My granddad had rentals (residential houses and apt's) for around 45 years. There is NO way to stop people from legal use of their residence. In FACT, there is ALMOST no way to stop them from ILLEGAL use of the property... We had called the cops on a renter there that appeared to be dealing drugs out of one of the apts. He had refused entrance to my granddad (not legal under the rental agreement). Then, there was a big bust. The DEA and Sheriff's dept came in at about 2am and kicked the door in. Grandpa was out of town so dad and I dealt with the DDA that was out there. they wanted to take the ENTIRE property via Rico (not gimpy). There was a LONG discussion and luckily one of the SacPD officers remembered being called out there before. End result was, they took EVERYTHING out of the apartment (including furnishings provided by my grandpa) but didn't go after the property.

Irvine company has always been crazy strick on businesses.

No gun stores.... And anytime a club gets the permits....they do everything they can to shut it down. Lame

I have yet to hear anything about them restricting guns in your place of residence.

Yeah, that's why I was asking if it was the residence. It's not legal, but it wouldn't surprise me if the Irvine Company tried something like that.

Sorry guys this was for my business lease... I don't know what would stop them from including this on personal residences as well... My 3 year contract was up last month and they wanted to raise my rent 40% + they threw in this new thing... Needless to say I found a new landlord and I actually have a gun shop in my complex WHEEEEHOOO!

So their policy also extends to customers? Assuming a customer has a CCW which gives them permission to carry in all public buildings, does that mean the landlord thinks they can usurp an american's rights?

you obviously don't know the Irvine company... they usually do whatever they want... Donald Bren was #23 on Forbes 500 richest.

Not to be harsh, but this statement isn't correct in reality. That is why we don't like the "no guns allowed" signs. The property owner does indeed have the right to exclude even CCW's from their property. Funny (NOT) thing is that other than hospitals and gov't facilities, i've only seen these signs at gun stores!

BTW, this is my reason for shopping mail order instead of the "local boys". If the local store doesn't believe in CCW, I won't spend my money there. In the Sacramento there are two gun stores I know of that have "no loaded gun signs". One is "Wild Sports", the other is "The Gun Room".

Default Rancho Codova Shooting Supplies

East of Sacramento,

RC Shooting Supplies seems prety level headed. Very small store in quiet strip mall. I was filling out paperwork and the guy made my CCW card in my wallet. He asked for it to use to fill in the info for the purchase. He winked at me, asked what holster I was wearing, and approved of the VMII. I never mentioned I was, and he never asked if I was carrying. Kind of a don't ask don't tell mentality.

Wild Sports enjoys staring you down when you walk through the doors. They have some weird mojo going on there. Definately not very gun friendly lately.

Are you speaking of Rancho Cordova Guns on Zinfandel near Sunrise? If so, i agree with you whole heartedly. I have bought a half dozen or so lever guns from them and before i met "a guy" i bought my handguns there. They are good folks.
