Default Do I Have A Shot?

Greetings!

I am a firearms instructor living in Santa Monica; do I have a chance? If so, where and how do I start the process?

Ask yourself if you carry "valuable equipment" or "large sum of money" on a regular bases. If the answer is yes... you DO!

Welcome FVK. According to LASD records as of 9-06, there are 8 CCWs out in Santa Monica. Almost all are judges, attorneys, retired LEOs. The bottom line, unfortunately, is that in LA County your chances are not good at all. If you still feel like applying you should investigate the process completely. If you havent already looked please have a look at the LA County FAQ.

Retired LEO's don't need CCW's.

In the off chance they don't want to carry thier ID and they get in a situation where a bad guy takes their wallet. They would not be identified as a LEO. This happened in Buena Park in 1997 with an LASD deputy (Dep. Shayne York) and he was murdered because of it. Him and his fiancee were both unarmed at the time. (York, Shayne)

I don't know the protocol for retired FEDS. Local LEO's have a retired ID that states they can be CCW. At least the several I've seen.

I think the only, or at least most of the active CCWs in San Fran fall into this catagory. In other words by law they have no choice but to issue. Otherwise they wouldn't

Prior to HR 218 being signed into federal law, retired Federal Officers/Agents, needed to apply for a CCW where they lived.

Retired POs have an endorsement just like when they were working, with the same restrictions (Or lack of).

The only difference with HR 218 now, is that the retiree needs to qualify every year.

Yes...I have several friends who are retired Feds, who don't have the ability to CCW...because they never bothered to apply under HR 218. If they did, they could carry.

I may have misunderstood my friend, but even as a retired local LEO, It appeared that he still had to indicate his desire to have the CCW "endorsement". I'll have to clarify what he was saying about that though.

There is no CCW to apply for. If they meet the criteria they can carry. Just like a FT LEO does not have a formal CCW permit issued.

How does the Law Define "Qualified Retired LEO?"

(c) As used in this section, the term `qualified retired law enforcement officer' means an individual who--

`(1) retired in good standing from service with a public agency as a law enforcement officer, other than for reasons of mental instability;

`(2) before such retirement, was authorized by law to engage in or supervise the prevention, detection, investigation, or prosecution of, or the incarceration of any person for, any violation of law, and had statutory powers of arrest;

`(3) (A) before such retirement, was regularly employed as a law enforcement officer for an aggregate of 15 years or more; or

`(B) retired from service with such agency, after completing any applicable probationary period of such service, due to a service-connected disability, as determined by such agency;

`(4) has a nonforfeitable right to benefits under the retirement plan of the agency;

`(5) during the most recent 12-month period, has met, at the expense of the individual, the State's standards for training and qualification for active law enforcement officers to carry firearms;

`(6) is not under the influence of alcohol or another intoxicating or hallucinatory drug or substance; and

`(7) is not prohibited by Federal law from receiving a firearm.
