Default Santa Clara County CCW

Hi,

I'm new to the board, and after doing some searching, noticed that Santa Clara County is not listed in the FAQ.

I live in the South County (i.e. Morgan Hill/Gilroy) area, and was wondering is anyone has had any luck down here as it's still very rural?

An example of this, and the reason for my new found interest to even start the discussion is that when i was walking my dogs yesterday (both of which are 70 pound hunting dogs) we ran into a coyote and things got ugly.

Any thoughts? I've already sent a letter to the local COP asking for their policy, and for the last few years records as suggested on another board.

Thanks in advance for any/all suggestions.

Welcome!

I've seen posts from members down your way, and I remember correctly, Santa Clara County is still Santa Clara County. Since you are in South County, the COP in the city you live in may have a different policy than the SCC Sheriff that could work in your favor.

I too am waiting to hear the response from your COP. Depending on which of the 3 South County cities you live in (Morgan Hill, San Martin or Gilroy), and what agency provides LE for that city, that will be the policy you need a favorable ruling from. All that is assuming you don't live in an unincorporated area that the SCC Sheriff has jurisdiction over. His issuance policy is pretty well known.

Most cities in that area have declared PC12050 (G)

IMPORTANT – a police department (PD) may enter into an agreement that pushes all applications, renewals, and amendments of licenses to the County Sheriff.

If an agreement is in place, the PD must refer all applicants to the Sheriff. If the PD refers ‘average citizens’, but has issued, they are in violation of this law.

If an agreement is not in place, then the PD has the option to issue.
This is referred to as a ‘G’ when referring to PDs that defer to the Sheriff for issuance.
I love it when he does that. It assists in learning. The end result may not be in your favor with the SCC Sheriff unfortunately.

I believe that most, if not all, cities in the South County area have declared "G" and are supposed to refer ALL CCW applicants to the Sheriff. She's not too keen on issuing them, although some people do get them. Santa Clara County is a very tough nut to crack. Only a few counties are worse. I live in one of them.

i don't live in an unincorporated area, and live within city limits. i've read elsewhere that the COP takes the 1st pass at all ccw permits, and then passes them on the sheriff, but that info was dated 2 over years ago. the other posts here seem to validate that.

if the COP responds, i'll let you guys know.

Default Santa Clara

Santa Clara Sheriff basically won't issue unless you are connected.

There is a active gun rights group, the Golden State Second Amendment council, they have a monthly meeting at Harry's Hofbrau in San Jose, corner of Keily/Saratoga avenue just off I 280, the last thursday of every month.

Next meeting will be Jun 26 at 7pm.

Alot of people who have been involved in gun politics in Santa Clara show up at this meeting.

For those of you who can make it, it gives you the opportunity to meet people who take action.

Considering the Heller decision will be out, this month's meeting should be very interesting, would be worth attending.

Adidas

Attorney Don Kilmer usually shows up and I could see him giving taking questions to see how Heller can help.

Default Santa Clara CCW permits

Santa Clara county probably is apporaching 2 million people living in it by now.

The numbers of ccw permits are probably around 130 or so.
Saying CCW permits are not available is an understatement.

When Sheriff Smith first got elected, she revoked the ccw permit of a bail bondsman.

The fact that he made a campaign contribution to her opponent was probably just a unfortunate coincidence.

The only way to know for sure who she is issuing to would be to do a public records act request for ccw data. Expect games.

A good indication of wheter or not games get played with ccw permits is how much trouble you have to go through to even get an application.

You will probably find that if you get a sheriff on the phone, they will probably try to strongly discourage you from even applying.

I would estimate that the numbers of people who would apply would be significantly higher if they weren't told over the phone that they had no chance of getting a permit.

Good departments make the application readily available, schedule interviews in a reasonable manner and treat you with respect.
