Sorry...that won't work. Those are B&P laws related to security guards - and what they can and can't do while operating as PPO's, etc. There is also NOTHING about State Seals in that code section and if there was (which there isn't), it would only relate to security company, guard, or PPOs.

7582.28. (a) Any badge or cap insignia worn by a person who is a
licensee, officer, director, partner, manager, or employee of a
licensee shall be of a design approved by the director, and shall
bear on its face a distinctive word indicating the name of the
licensee and an employee number by which the person may be identified
by the licensee.
The provisions of this section shall not be construed to authorize
persons to wear badges who are prohibited by Section 7582.26 from
wearing badges.
(b) The director may assess a fine of two hundred fifty dollars
($250) per violation of subdivision (a).

NM...Late to the party again.

I'm pretty sure that the state can nail you for trademark infringement (or whatever the state seal is) if it came down to it

Remember, this is california, the state where DOJ makes stuff up as they go along

I will let RD weigh in on that...but I'm pretty sure there's no such thing as "trademark infringement" when it comes to the government seal. You also have to remember we have a 1st Amendment. If I want to wear a tee shirt with the State Seal on it, there's nothing anyone can do about it.

In fact, I know a guy who has a tee-shirt with the California Seal on it for his business. He changed one small graphic in the seal so he can point that out to anyone. Another affiliate has an actual badge advertisement with the State Seal on it and they've used it for 20 years.

You are correct. The phrase "a design approved by the director" gives broad bureaucratic authority to DCA. Typical California.

Yeah. We're talking about laws specific to Consumer Affairs, which is a reglutory agency for specific licenses. Those particular laws in the B&P are for this agency to regulate uniform appearance on guards.

It has nothing to do with the general public. Remember it's the BUSINESS....AND...PROFESSIONS...code. It's for Businesses and Professions, such as PPO's, Private Mailbox, Process Servers, Private Investigators, Lock Smiths...et al.
