Santa Ana Municipal code states that firearms are not allowed in their parks. The zoo is in Prentice Park; therefore, firearms are not allowed.

Quote:
Sec. 31-2.5. Firearms and dangerous instruments.

(a) No person, except an authorized law enforcement officer, shall bring onto park property, other than at such firing ranges as may be specifically designated by the director, any firearm or ammunition, any explosive, dynamite cap, fireworks, airgun, pellet gun, spring gun, slingshot, bow and arrow, or any other dangerous instrument.
(b) No person shall discharge any weapon or dangerous instrument in a park other than at a firing range as specifically designated by the director for such purpose.
(Ord. No. NS-1572, § 6, 4-20-81)
There is no exemption in their codes for CCW that I could find.

Default Dumb Question

I would say that the code doesn't address CCWs because whoever wrote it probably never even considered the fact that a citizen might legally carry. I don't see how a city can write in a code something that over-rides a right granted by the state. Couldn't every little burg just write up a code that says CCWs issued by the state aren't recognized by their city?

Just asking....don't jump all over me!

Unfortunately they can... to a certain extent.

They can only write codes for those areas that the state has not already got covered. Municipal airports are one such case, as mentioned in that thread and the one that that started from. However, if a city could just pass a municipal code banning weapons, then CCWs would not be valid in San Francisco. This is not the case.

I'm no lawyer but I suspect that preemption applies.

From the thread that I linked:

Take Orance county muni code 2-5-237 or even Mission viejo municipal code Sec. 13.04.030. for park and city parks

There is no wording or exemption for LEO. With the Airport it does expressly say only LEO.

But where it is not clarified it could fall back to:

Muni code 202
202. General Law Governs.
Except as expressly set forth in this charter, the general law set forth in the Constitution of the State of California and the laws of the State of California shall govern the operations of the County of Orange.

This is an item for discussion not a statement.
