Default If no ccw license, can we unlock case container and prepared load the gun

Today, I was working as construction and being alone myself to eating my lunch. I was sitting inside my truck on the drive way near the house. I saw 2 gangsters, he was driving to the end of the road and turn around back to the road. Both gangsters were staring at me and they were gone. I was continuing eating my lunch, but again two gangsters came back and was staring at me while he was driving to the end of the road. I was immediately pull my case container out and unlock container, then I load my gun and pull slide one round in the chamber. I hold my gun and it sit on my leg and put my food away. I didn't have no time to call police myself. When they were turn around and came back, and they were staring at me for no reason. Lucky I am safe, they were gone out.

Question: I don't have ccw license, but I am allowed to unlock container and load the gun, because I am fear in danger? I didn't call police after they left. I was waiting for third chance if they came back to me, but nothing came back. So then I go back to work doing the tile work in the house.

There are circumstances where you can have a loaded gun if you feel your life is in imminent danger. With that said, CCWI is the expert and I am sure he will chime in.

Your post really begs the question as to why you had the gun in the first place. Even if in a locked container, you're not allowed to transport a gun in your car "just because", unless you have a CCW and it's one of the guns on your permit. The law has specific exemptions that permits you to transport a gun, but since you were at work you likely didn't fall within any of those exemptions (going to/from the range, a gun dealer, etc.)

You might want to read penal code sections 12025 - 12026.2. Those sections deal with concealed weapons and the exemptions to carrying in your vehicle.

You had time to get your gun container, open it, remove and load your firearm but no time to dial 911? Or how about starting your truck and driving away?

And why are you driving around with a gun in your truck? From past posts and now this one it seems to me that you are just an incident waiting to happen.

Wouldn't this refer to transporting to and from the range only? Or am I remembering it wrong?

you are correct, and it gives many many many scenerio's and penal codes to which goes with what. I have read the book twice. Knowing the law will save someone for making a costly mistake like having no ccw and having a loaded gun in the car.

Two "gangbangers" driving by in a car and do not threaten you in the least. You unlocked your handgun, load it and set it on your lap in plain view???!!! uhhhhhhhh?????

Even WITH a CCW you could not get away with this type of behavior!!! You are VERY lucky THEY did not call 911 on YOU. If they did you would be sitting in jail tonight looking at some pretty serious charges.

Are you still wearing your bullet proof vest daily?

PTL: I see NOTHING that says that the two people in the other car were actually threatening you or put you in immenent danger. By loading your pistol, you most likely committed a crime, if not several.

Gentlemen... I won't comment on the legality of what PTL did as it's been done already. I won't even comment on how rekless his actions were. We are here to educate and hopefully prevent thisfrom PTL again and anyone else that happens upon this thread.

So how about some advice on what SHOULD have happened?

For the record, it's stool to me.

I think PTL should haved drived away from places he did eats lunch because not safe. If I be him I chooses most safes places to eats my foods.

I would have to agree with '03 here. PTL could have done some things better. Much better. If PTL thought he was in danger, the first thing that should have come to mind is to clear from the area. Otherwise, his next thing to do is to call for Law Enforcement, if he feels threatened. Knowing the 7 digit local number for 911 dispatch or having it handy on the cellphone is a good idea. Loading the pistol should be one of the last things on the mind. Being aware of the surroundings is a good thing... but those guys could have been watching you because perhaps you were out of the ordinary for the area...

Like Mike said, the "How to..." book sums it up best, but it's also in the penal code sections I quoted. Basically, the law says you can't transport a gun in your car unless you have a reason to (an "exception" in the book/code.)
