PTL, unless you want to draw attention to your self, having a loaded gun on your lap in public view might get you the trouble you don't want. Nevermind your violation of the PC that determines what is considered legal transportion of a handgun. (note the PC sections above apply to handguns)

If you had time to unlock a case, load the gun, place it on your lap and continue to observe the possible BG's, then you had time to call for the PD or leave the area, unless you have a third hand and could call the police while unlocking the case.

I fully understand your fear, and concern, when things look bad. But, the law is the law. Unless you have your range bag in the truck and had plans to go to the range or the gunshop, you crossed a line that now puts you and your right to own guns in California at risk.

So you are saying PC 12026.1 doesn't allow me to carry my firearm locked/unloaded in my vehicle for any lawful purpose?

PC 12026.1 and PC 12027 are both exceptions to 12025; not rules of where we can transport an unloaded/locked firearm.

If we were only allowed to keep an unoaded/locked firearm in our car between certain places, then every time we disarm and lock our firearms in the car we are violating the PC. There is no exception for CCW license holders in 12027, except for LEO and retired LEO.

Setting aside if you should or could or can have a gun in the car.

Next time you feel a threat from a BG and you have the sort of time you say you have, start the car and drive away. If followed head for the closest Police Station, if you have a cell phone call 911.

Using or brandishing I firearam in anyway has to be the very last thing to do in order to save your life.

To answer your question given your circumstances the answer is NO.

Even with a CCW our first thought must be to create distance, find cover, seek help.

In the truck on the driveway near the house. That is on private property. Does that come into play?

A person in most cars can not see into a truck. And if it was in a drive way it is even more difficult to see in.

You guys are giving good advice. But why would you run and hide because you are being cased. If he had a CCW then he could stand his ground but because like most we can not have one then we have to roll over and give up? How about this.

Do not carry a pistol in your truck. Carry a short barrel shotgun. Legal and you do not have to case the gun. 16' barrel and 30' over all with buck shot, then stand your ground and be legal.

Um - you better not have a 16" barrel shotgun in your vehicle or anywhere else.

Choosing to leave the area is smart advice with or without a CCW. It's ALWAYS best to avoid a confrontation whenever possible.

#1. He does NOT have a CCW
#2. Standing your ground is unwise, it can become an ego issue. Best course of action is to retreat to safety. Use weapon at your disposal as an ABSOLUTE LAST RECOURSE.

Correct, the 16" applies to rifles, not shotguns. Shotguns need to have an 18" or longer barrel.

I assume that if I have no choice but to fire my legally held weapon, it will cost me a minimum of $50,000.

Where is the threat? General fear of crime and profiling won't hold water. Do you have any training or experience in identifying GBs? Since they never stopped, I am guessing you weren't close enough to see any gang tatts. Sounds like you were staring at them as well, but you were the one with the loaded gun. ??????

Few things to consider when you end up in court.

Just glad to hear that nobody got shot.

Public view. That is the standard, and upheld by case law several times over. Check our FAQs section for applicable case law.

Sorry about the wrong size. Been dealing with rifles lately. Still if you need protection carry legal. A truck gun is legal.
