Default New question for encountering LEO

Here's a question I pondered this last weekend while attending my wifes high school reunion. Where I live they have these random DUI checkpoints, mainly on weekends. Some folks around here look at them as some kind of Gestapo tactic since they really don't make many DUI arrests but, that another subject discussion for another day. They will run hundreds of vehicles through them and usually only get maybe 2 or 3 drunks out of the deal. They do however grab plenty of unlicensed drivers and other notorious vermin of the sort and impound plenty of cars.

My question is...if and/or when I go through a check point, do I need to advise the officer that I am CCW? My gut feelings are no, unless asked to present ID or something. However, in my county I believe I'm supposed to advise upon any contact with LEO. Any shared thoughts on this subject would be greatly appreciated!

My issuing authority doesn't require notification. I have had two contacts with LEO since I have been carrying. The first was a quick pull-over in Nevada (about 5 years ago and I was new to CCW) for speeding and he never even got to his cruiser door when he turned around and returned my ID with a verbal warning. I did not notify on that stop. The second stop was in my home neighborhood by the CHP and I gave him both my ID and permit at the same time. I was lucky this time again and received a verbal warning along with a 5 minute conversation.

If pulled over for a traffic violation I would lean towards offering my permit with my other documents even though I am not required,,,, and you never know it may grant you a reprieve along with interesting conversation. For your DUI, no I don't believe it is necessary unless you are requested to present ID.

I would confirm the part I bolded first. Then base your answer off of that. I wouldn't consider driving through the checkpoint without them stopping you contact. If you are the lucky car that is stopped, then that is contact.

If you have a Sheriff's Dept. permit...
yes...
it is a professional contact...they are contacting.....
You might want to wait until they actually pull you aside though...

the wave might get you pulled over...
most people don't even get slowed down though...
Our dept. works the dui checkpoints...the officers are looking for the telltale signs....
toothless and driving and your pupils don' react at all when I shine a sure fire flamethrower into the eyes...
driving with that green tongue four of your "homies" and a cloud of smoke in the car...
driving with a 5th of Jack Daniels in one hand while you talk on the cellphone and smoke a cigarette...
driving a car that was last registered when Bill Clinton was the adulterer in Chieff...
Driving a car that is not readily identifiable as a motorized form of transport but is nevertheless moving on wheels and a cloud of blue smoke...

Unofficial Rule of thumb: If an LEO asks for your ID you have been "contacted" by the LEO. If they make small talk and wave you through a checkpoint, it's not what I would consider being "contacted" by a LEO.

Yes...I do have a KCSO permit. My thoughts were, if I was pulled aside then I would show my permit. If I was simply waved by and just passing through the check point, then I wouldn't consider that a contact by LEO. I can assure you I don't fit any of the criteria of your former post! Thanks for your input!

Default DUI checkpoints

I supervised a number of checkpoints for CHP. At out checkpoints, we wold stop 2-4 cars at a time, each with an officer at the drivers door. If not down already, we would have the driver lower the window. We would explain the reason for the delay and present the driver with some literature relating to drunk driving and them let them proceed. No DL, reg or insurance info was asked for. If some observable signs of DUI were detected, the person was directed out of the traffic lane and to another close by location for further investigation. If you are not asked to pull over, then I would consider it not a contact. As a supervisor, I had to maintain a chart on what order vehicles were stopped in. Had a sheet with 100-150 numbers on it. Crossed out the number that corresponded with the vehicle stopped at the checkpoint.

Some city PDs and SOs conduct license and registration checkpoints. It looks the same as a DUI checkpoint. Except when the line of cars is stopped, they specifically ask for your DL, registration and insurance info. This is a contact. When I retired in 2006, CHP policy was not to participate in these types of checkpoints. Part of the reasoning was while it was ok to set up a DL checkpoint, the courts won't allow a car to be stopped, not at a checkpoint, for the same reason.
