Default Fish and Game contact

I fish, there for I get to see Fish and Game often. I had my first encounter Saturday since getting my permit. He drove up and asked if we had been fishing. We said not yet, but are about to. I then said "officer, I have a CCW and am armed. Okay to get my permit from my wallet in my back right pocket? My firearm is on my right side hip." He said yes. I took out my wallet and got out my permit and handed it to him. He looked it over and handed it back. I then showed him my fishing license.

It went so smooth. This guy even shared some fishing tips and location where he had caught fish recently. Awesome!

I don't think that interaction rose to the point where notification was required.

Even if it is required by your IA.

WTF? Who are you to say that. Do you even know if his issuing agency requires it? When a officer ask you a question, you now have a official contact.

Under the 4th amendment that is called a consensual contact.

Key word is contact. Either way professional courtesy come into play. More and more states are requiring notification on CONTACT.

For me anyway, the usual first word out of a game wardens mouth are "do you have any firearms in the vehicle?"

Never had a problem after being honest with an officer.

In the past 6 months I have had 2 encounters with LEO's while armed. Bear with me as I set up the scenarios. In one instance I was on a photo shoot in a rural area, my car was parked on the shoulder of a State Hwy. A CHP officer on patrol noted my unoccupied vehicle and slowed to take what I believe to be, a closer look. He was not immediately able to see me because I was partially hidden from his view by oak trees. He moved his car forward a bit and then he saw me with my camera set up on a tripod. He asked if the vehicle was mine, I said yes and he waved and drove off. A few minutes later he came back but this time he stopped and exited his vehicle. I introduced myself and told him where I lived. He indicated that he stopped to take a break, smoke a cigarette and just chat. We engaged in idle conversation and after smoking his cigarette he left. Never once did he ask to see any ID.

In the second instance I was riding my Harley and had pulled onto the shoulder of a State Hwy to wait for a fellow rider. We had arranged to meet at that location and I arrived first. Shortly, a CHP officer pulled up, exited his vehicle and asked if I needed any help. I told him no, why I was parked on the shoulder, and further explained that the club I belonged to was going on a run that day. He said have a nice day and drove off. He too never asked to see any ID.

In neither instance did I inform the officers that I was armed. Since neither of the officers asked to see any ID, I did not believe that these contacts warranted such notification. However, had either of the officers requested to see my ID, that would have increased the level of contact. Then I most certainly would have advised them of my status.

I think it all comes down to the individual situation and the people involved. We should not blurt out "I have a gun and a permit" as soon as LEO shows up and justify it as being required to notify.

At some point we need to think about whether this is an "official" contact or just the officer saying "Hi, have a nice time today." One is in the professional capacity. The other is personal. There is no requirement to notify if it's just personal.

Game warden checking to see if you're legal? Yep it's an "official" contact.
Standing in line at the grocery checkout and shooting the breeze about them Lakers? Should be obvious this is a personal contact.

That would depend on a couple of things...
One, does your issuing authority require you to notify when contacted?
Second, if so, what does contact mean?

From dictionary.com:
Quote:
noun
1. the act or state of touching; a touching or meeting, as of two things or people.
2. immediate proximity or association.

3. an acquaintance, colleague, or relative through whom a person can gain access to information, favors, influential people, and the like.
4. Electricity . a junction of electric conductors, usually metal, that controls current flow, often completing or interrupting a circuit.
5. Geology . the interface, generally a planar surface, between strata that differ in lithology or age.
According to these (in bold), i would suggest you were mistaken....

My IA does not require notification upon contact with a LEO.
