Thanks for sharing your experience. Glad it went well.

My friend who is a CHP officer is very pro CCW. Although he has an admin job and hasn't been on patrol for years. He says that he is grateful that citizens carry - believes it reduces crime.

My understanding of the law in CA is that you do not have to tell the Officer you are carrying for just a traffic stop. If you are asked if you have a firearm you then give the Officer your permit or if you are asked to step out of your car.

The requirements very county by county. SB County requires that you disclose upon official LEO contact. Official contact being any reason for the officer to ask for ID.

There should be nothing wrong with an officer knowing that a law abiding citizen is carrying a loaded firearm.

There is no law in CA that states you must show to LEO upon official contact. This is a requirement placed in the permit by some counties. It IS LAW that all requirements and restrictions must be printed on the permit so if it is not printed on the permit then it is not legally binding. HOWEVER, if your issuing authority told you verbally or in writing (not actually on the permit) that you must disclose then it may give them cause to revoke your permit for failure to follow their rules. Remember, the permit is THEIR PROPERTY and can be revoked at any time. Check with your IA to determine if you must follow this requirement.

I was told by San Bernardino county that if we were directly being questioned by a LEO (like a traffic stop), then we have to disclose if we are carrying. Also, we were told that carrying concealed means carrying on person. Within reach is not on person therefore not allowed.

Well that is not true, because a permit exempts the carrier from:

12025:

Quote:
(a) A person is guilty of carrying a concealed firearm when
he or she does any of the following:
(1) Carries concealed within any vehicle which is under his or her
control or direction any pistol, revolver, or other firearm capable
of being concealed upon the person.
(2) Carries concealed upon his or her person any pistol, revolver,
or other firearm capable of being concealed upon the person.
(3) Causes to be carried concealed within any vehicle in which he
or she is an occupant any pistol, revolver, or other firearm capable
of being concealed upon the person.

yes, there are no specific interior areas of a auto mobile, including a motor cycle, that is off limits for concealed carry, as long as the weapon is out of plain site from anyone looking in through a window,as long as it is hidden from plain site,it is legally concealed, and meets the calif code for concealed carry, according to the calif DOJ,also, no county currently issueing concealed carry permits in the state of california, requires the permit holder to notify a law enforcement officer that he/she is in possesion of a concealed weapon, unless asked by the officer..

My county does not require that I disclose to the officer about my CCW unless asked. Therefore...and I know this goes against the grain with most people here...I never inform the officer about my weapon (unless asked of course) and I've never had a problem.

I know there have been many wonderful and non-eventful encounters with LEOs regarding CCW holders here and that is great. But, unfortunately, there have also been a few negative ones as well. A recent thread on this very forum comes to mind where the OP was pulled from the vehicle, hands placed on top of head, searched, and then sat on the curb until his permit was verified. I'll just as well avoid this embarrassing and unnecessary treatment from the officers by simply not informing them of my CCW. Sorry, but until I feel that California LEOs fully respect the Second Amendment rights of law-abiding citizens, I will keep my business to myself and, (again--unless asked about it) will not volunteer information regarding my weapon or permit during a routine traffic stop/encounter with police.

Does anyone know what the 'legal' procedure is in Riverside County. Do you 'have' to disclose you are carrying if pulled over or questioned and not asked specifically?

Personally I would just hand my permit over with my license. I don't know if I would even want to give the 'impression' of not complying. One over stressed cop decides to give me a ticket for it or something like that and 'poof' the permit is gone. Not worth it to me.....

Now with that question answered.....'Should' we disclose to avoid the appearance of 'foul play' or anything?

I look at it this way you are not a criminal and if you are concealed properly then there is no reason to tell them and add stress to their day. Now if they ask you step out if the vehicle then you may want to say something.

I assume you hand over your permit with your license though if pulled over?

I have nothing to hide. If I get pulled over my permit is right next to my DL and will be handed over.

If the officer feels they need to get me out of the vehicle with hands in the air, handcuff me and put me on the curb, well, their attorney and my attorney can have a discussion.

Until that time, I respect them and the job they do and ask that they respect my rights in return.
