I really can't tell where the brass markings are on the slide. It is not unusual to have brass markings at the aft end of the ejection port. If you plan to send this back to Kimber for corrective action, I would leave it the way it is and ask them to take care of that as well.
Good picture and illustrates the contact pretty clearly, if you know what you are looking for. It does look like the side of the bullet is making contact.
Before you send it back to Kimber, I would shoot it some more and have a camera handy. On your next stoppage, take a picture of the condition and enclose it with the gun to Kimber.
The O-Frame is not an out of the box and shoot'm type gun. But some Glocks also come with their share of flees. I've learned a lot from just working on my Springfield. I've put > 15k rounds through mine and I'll put it up against any Glock in terms or reliability.
One last thing, when you send the gun back to Kimber, tell them to ream the chamber to spec. They do tend to come out on the tighter side.
