Very well stated. The folks that use Ham radios are usually much more aware then the folks using cell phones to chat and gossip while screwing up traffic. It is a whole different format.

The pedestrians were the more obviously ridiculous, taking out cell phones and placing them to their ears, then j-walking or crossing streets against lights without touching a button to activate the devices.

Have you guys seen the array of Bluetooth devices available......Shoot, don't know which is the hot set up.......I might just use a wire one till I sort out what is good bang for the buck!!!!! I have a headache!!!
I use a headset with a wire in the airplane, have been doing for a long time, so it is no big deal..

You amateur radio guys be careful out there. The CHP may cite you unless you fall under one of the exceptions listed in CVC 23123(e)

Q: What if my phone has a push-to-talk feature, can I use that?
A: No. The law does provide an exception for those operating a commercial motor truck or truck tractor (excluding pickups), implements of husbandry, farm vehicle or tow truck, to use a two-way radio operated by a “push-to-talk” feature. However, a push-to-talk feature attached to a hands-free ear piece or other hands-free device is acceptable.

CVC23123 and 23124 regulates the use of "wireless telephone". I could not find a definition for "wireless telephone" in the CVC so in that absence, I would have to use the common understanding that a "wireless telephone" is not the same as an amateur band radio or a chicken band radio. CVC 23123(e) even uses a more narrow definition: "a digital two-way radio that utilizes a wireless telephone".

I'd be happy to use a wired one if

1) The earpiece was loud enough to hear and
2) It used a boom to actually put the mic in front of your mouth, instead of on the wire dangling somewhere around your armpit.

I'm not slow. I'm telling you the CHP could care less what the DMV says. Officers are going to interpret and apply the law their way.
CVC 23123 does not specifically exempt two-way radio use. So, expect some misapplication of the legislative intent until some judicial clarification is made.
