Default Orange County Supervisor Requests Supplemental CCW Item for Tuesday's Agenda.

Orange County Board of Supervisior & Vice Chair Patricia C. Bates has requested a supplemental agenda item for November 25, 2008 regarding any unintended consequences CCW revocations appearing on a citizen's Department of Justice record in the same manner as if the license had been revoked because of criminal miscondunduct or other wrong doing. A copy of that request is available at Calgunlaws.com. (See item 11).

From my point-of-view, if you have been issued a CCW after passing all the OCSD's vetting and they change the rules, revoking your CCW and telling the LE planet that you are revoked, you have been had your here-to-fore clean record violated.

If I were to do the same in any contract I signed with a vendor, changed the rules of the contract, and ruined the personal reputation of the contractee, what do you think would happen?

Are they not addressing the 90 day CLETS issue as well? I just don't see anyone standing for even a 1 day blemish on ANY record.

And, as it turns out, it is NOT just for 90 days. She was completely wrong on that.

Santa Ana Chief of Police Paul M. Walters submitted a letter to the Orange County Board of Supervisors clarifying his position on CCW issuance. Chief Walters stated that his policy is more open and responsive to the wishes of most County residents. He also stated that he would not have issued intent to revoke letters unless there was a clear justificcation that the permit was obtained through nefarious means or that they [CCW holders] have violated the terms of their permits.

Additionally, a copy of Purpose, Evolution, and Legal Effect of Opinions of the Attorney General of California is provided to clarify the following points discussed at the Orange County Board of Supervisor's November 18, 2008 meeting: 1) Attorney General Opinions are advisory only and do not carry the weight of law; and 2) the value to be given an opinion of the Attorney General does not depend so much on general judicial descriptions as upon persuasive force of the reasons given in the analysis to support the particular opinion. In otherwords, Sheriff Hutchens' is not bound by the indexed letter opinion upon which she bases her opinion.
