Default Qualifications for Sheriff?

Are members of the sheriff's department required to recertify every year? If so, does this mean the sheriff is also required to do so? On the range: Distance? Score? Off-hand? From draw?
What about PT course?

You very well may be correct. However I do not believe she has qualified yet. There is a time limit to do so after gaining the position.

If I am incorrect I am sure someone will be along to provide the information.

They generally qualify quarterly... but at least once every six months.. on whatever they consider a qualification course... varies by agency... the Probation Dept. I work for mandates monthly practice and quarterly qual. - there is an incentive pay system for staying in shape...

The elected Sheriff of a county in California does not have to qualify nor does he or she have to be POST certified. The fact that a majority of people voting deems him or her to be qualified trumps the qualification/POST certification requirement.

Whether or not an appointed Sheriff enjoys the same immunity is a question for some of our legal eagles (or is that beagles?).

Sheriff in California must have Intermediate POST certification.

Also YES, Sheriff's must qualify, look at San Francisco....If i'm not mustanken that the SF Police Chief never qualified for like 4+ years or something, I remember reading something about it. I am sure others know more.

I don't believe that's correct. California Penal Code Section 832.4 specifies that they have 24 months to achieve basic POST certification once they take the role of Sheriff or Police Chief, whether elected or appointed. (this was an issue for LAPD when they appointed Bratton since he was from out of state. I imagine our SME will chime in here sooner or later and let us know the real scoop.

But since the current OC sheriff was retired only a year ago from LASD, I don't know if her POST certification even expired before she got this job.

POST certificate stuff expires 3 years after you leave a position. If she retired a year prior to taking this new position, her POST stuff should still be current. Another question to ask about is whether or not she's also been doing her CPT... which (IIRC) is also part of the currency process.

Her POST is current (3 years), and now that she's a LEO, it would take another 3 years out of LE for it to "expire". If it expires, like mine, you have to have a 132+ hour renewal course at any POST certified school/dept./acad. I looked into it and it would take three weeks in Yuba to get it current. The classes are patrol, victimology, traffic stops, etc. It's a refresher course.

That's my understanding of the process. Because she only went about 1 year before becoming the SHEriff, she didn't actually "expire" her POST. So... that 3 year clock got reset and once she leaves office, she'll have 3 years to find another one or she'd have to take the renewal course.

The 24 hour CPT requirement does not qualify at her rank.

Old Timer was talking about the old law.

Years ago a Sheriff in California (Brad Gates) lobbied to get the law change. A civilian by the name of Colleen Campbell was going to run against him. He got the law change and shut her down. One current Sheriff is still grandfathered in under the old law.
